EB-5 Extension 2019

Latest Update – As declared by United States Citizenship & Immigration Services on July 24, 2019, the anticipated final rule has taken effect on Thursday, November 21, 2019. The minimum EB-5 investment amount has increased from US$500,000 to US$900,000 plus the processing overhead cost, legal and filing fees for the project which is located in a TEA. For the project not located in a TEA, the amount has increased from US$1 million to US$1.8 million plus the processing overhead cost, legal and filing fees.

Immigration reform has bought some more time for EB-5 visa applicants. This year the Congress has extended the EB-5 Regional Center Program once again. The extension took place several times in 2017 and 2018. At first the program was only extended for the time being in 2019 February 15th. Now the EB-5 has been reauthorized through September 30th, 2019. Thus, the rules and regulations will remain unchanged through September 30th, 2019.

This is advantageous for the investors who wish to file their EB-5 application with current EB-5 requirements. In this extension period, the EB-5 program requires the applicants to have a minimum amount of capital of USD$500,000 to invest in targeted employment areas. An investment in non-targeted employment areas requires USA$1 million. After this extension the amount can increase to $1.35 million for employment areas and $1.8 million for non-employment areas.
